JUSTICE THOMAS in dissent... "The Framers embodied that principle in the Constitution, allowing the government to take property not for "public necessity," but instead for "public use." "..."This deferential shift in phraseology enables the Court to hold, against all common sense, that a costly urban-renewal project whose stated purpose is a vague promise of new jobs and increased tax revenue, but which is also suspiciously agreeable to [a Corporation], is for a "public use." ...If such "economic development" takings are for a "public use," any taking is, and the Court has erased the Public Use Clause from our Constitution" JUSTICE O’CONNOR in dissent.

Going Beyond Headlines and Stereotypes

From the Beginning

Abolishing slavery. Free speech. Women's suffrage. In today's stereotypes, none of  these sounds like a typical Republican issue, yet they are stances the Republican Party, in opposition to the Democratic Party, adopted early on. Reducing the government. Streamlining the bureaucracy. Returning power to the states.  With a core belief in the idea of the primacy of individuals, the Republican Party, since its inception, has been at the forefront of the fight for individuals' rights in opposition to a large, bloated government.

(With a few exceptions, this could have been written in 2006 not 1850)

What, then, is law? It is the collective organization of the individual right to lawful defense.

Each of us has a natural right-to defend his person, his liberty, and his property. These are the three basic requirements of life, and the preservation of any one of them is completely dependent upon the preservation of the other two. For what are our faculties but the extension of our individuality? And what is property but an extension of our faculties?
